Understanding the role of next of kin in Australia

The Next of Kin is the person legally recognised to make decisions when someone passes away without a valid will. This includes funeral arrangements and estate management. In Australia, you don’t need to formally appoint a Next of Kin; it’s determined by a legal hierarchy:

  1. Spouse or domestic partner
  2. Adult child
  3. Parent
  4. Adult sibling
  5. Executor of the will
  6. Personal representative
  7. A person appointed by the coroner

What is a right of interment?

A Right of Interment refers to the legal right to be buried or to authorise burial in a specific cemetery space such as a grave, crypt, or cremation niche. This right is purchased, but the land remains Crown Land managed by a cemetery trust.

Duration of interment rights

  • Graves and vaults: Perpetual (forever)
  • Cremation spaces (e.g. niche walls, rose gardens): Permanent or limited tenure (up to 25 years)
